WAKE HARD PLAY HARD (“WPH”) is published by SILEX TECHNOLOGIES SA, a public limited company incorporated under Swiss law with a capital of CHF 100,000, whose registered office is located at rue de Villereuse 22 – 1207 Geneva, registered in the canton of Geneva under number CHE-179.108.891 (the “seller”), in order to offer water sports services and activities.

Depending on the context in which it is used in these legal notices, the term “customer” refers indistinctly to the person paying for the order, the person ultimately using the service offered or their legal representative.
In accordance with the Data Protection Act of 19 June 1992 (“LPD”), Article 8, the client has the right to access, modify, rectify and delete data concerning him/her. To exercise this right, a request by mail must be sent to WHPH, at SILEX TECHNOLOGIES SA, rue de Villereuse 22 – 1207 Geneva (Switzerland).
The customer is informed that the seller processes personal data concerning him/her, namely his/her surname(s), first name(s), image(s), postal address(es), email address(es), telephone number(s), and video surveillance images to fulfill his/her contractual obligations or commercial actions. This processing is carried out in accordance with the Federal Data Protection Act (FADP) and the Ordinance on the Federal Data Protection Act (“FDPA”). The seller also processes personal data, to the extent permitted by law, for the purpose of sending written or electronic information, advertising, and marketing messages. The seller may also send a newsletter to customers. The customer may withdraw his/her consent at any time by simply “clicking” to unsubscribe at the end of the promotional message or upon request to the email address indicated below.
Use of this site is governed by the terms and conditions set forth in this agreement.
The information and documents provided by WHPH may only be used for informational purposes. By visiting, accessing, or downloading data from this site, you agree to comply with the conditions set out here, which apply to all visitors to the site www.whph.ch

These general terms and conditions (“GTC”) apply to the sports and leisure activities offered by WHPH.
The customer accepts the conditions below without any modification and in their entirety. The seller reserves the right to modify the T&Cs at any time. They cannot be modified unilaterally for the order in question. No special condition or general purchasing condition (“GPC”) may, unless previously accepted in writing by the seller, prevail over these T&Cs. Any contrary condition set by the customer and appearing in particular in its GPC or in any other document will therefore be unenforceable against the seller, unless expressly agreed, regardless of when said condition may have been brought to its attention.
The specific conditions established or agreed to by the seller during targeted offers take precedence over these general conditions for the points they modify.
The seller reserves the right to modify the scope of its catalog of products and services and their prices at any time. Although the seller makes every effort in good faith to ensure the reliability of the information, the images, diagrams, and information appearing on the website www.whph.ch, its subdomains, in advertisements, brochures, and on social media pages controlled by it are provided for informational purposes only and do not constitute contractual documents.
Once the order has been placed, the customer receives an order confirmation. For any order placed directly on-site, the customer acknowledges that the last T&Cs accepted by them when ordering on the website will apply, unless new T&Cs are accepted on-site. The seller is not obliged to accept orders and may refuse all or part of them at any time without giving any reason. Any payment already made will be refunded. All services are payable in full at the time of ordering.
Once accepted, the seller reserves the right to cancel or modify any reservation, particularly for security reasons, factors beyond its control (weather in particular), or technical failure. In the event of cancellation of a reservation, the seller will attempt to inform its customers as soon as possible and will offer to reschedule their activities. If the seller deems it necessary to cancel a booked activity when the session has already started, the customer will be offered to participate on another date. No refund will be made once a rescheduling is offered.
The purchase of a product or service from the seller may only be canceled in cases provided for by law. This cancellation must be made by registered letter addressed to WHPH, at SILEX TECHNOLOGIES SA. The customer acknowledges that they are not entitled to a refund for their order. They will receive a voucher equal to the value of their reservation to be used within one year of their initial order.
The client agrees to respect other users, act courteously, and always follow the instructions given during the activities. Any violation of the rules of basic courtesy and safety rules will entitle WHPH to immediately terminate the session of the person concerned, without prejudice to any damages that WHPH may be entitled to claim, and without any right to reimbursement of the service for the client. The client acknowledges having been informed that video surveillance and photographic devices may be posted at various locations to ensure their safety during the activities, and that videos may be broadcast on the internet and social networks during the service, and photos used for promotional purposes, in compliance with the image rights applicable in Switzerland. The client also acknowledges being in full physical possession of their faculties, and in case of doubt, having consulted a doctor. The customer undertakes to diligently familiarize themselves with the safety rules specific to each activity, and this for each use, to remain cautious in all circumstances and expressly acknowledges that any activity involves a risk regardless of the customer’s level. Lost and found items are stored for 3 months within the establishment. They are returned only upon request from the customer and at their expense.
In accordance with Art. 100 of the Swiss Code of Obligations, WHPH shall only be liable for its serious misconduct, the concept of seriousness being assessed according to the case law of the Swiss courts in force at the time of the facts. WHPH shall therefore not be liable for damage caused to its clients’ property, theft thereof, and any material damage in general, without this list being exhaustive. In accordance with Art. 101 of the Swiss Code of Obligations, WHPH shall also not be liable for faults committed by its auxiliaries in the performance of their duties.
The occurrence of a force majeure event temporarily releases the party prevented from performing during the force majeure event and for an appropriate period of time after the end of these events. The term “force majeure” includes, for example, natural disasters, bad weather, wars, terrorism, political and social unrest, revolutions and insurrections, strikes, epidemics and pandemics, nuclear accidents or damage to nuclear reactors, involuntary production impediments due to, for example, water, damage to machinery, power outages, fire, etc.
Swiss law applies to the legal relationship between the seller and the customer. The competent court for any possible dispute is that of Geneva.
The invalidity of one or more of the legal notices and T&Cs does not affect the validity of the other provisions.
